These Terms of Service constitute a legally binding agreement between you and Bookmyhelp, Inc. (“Bookmyhelp”) governing your use of the Bookmyhelp Platform. Bookmyhelp’s website (www.Bookmyhelp.com) (the “Site”), mobile applications (the “Apps”), and related services, information and communications are collectively referred to as the “Bookmyhelp Platform.”
The use of all personal data you submit to the Bookmyhelp Platform or which we collect about you is governed by our Global Privacy Policy ( “Privacy Policy”). You acknowledge that by using the Bookmyhelp Platform you have reviewed the Privacy Policy.
Yor consent at registration and continued use of the Bookmyhelp Platform constitutes your acceptance of and agreement to all the terms and conditions in these Global Terms of Service, the Privacy Policy, and the Bookmyhelp We Care (the “We Care”). If any future changes to this Agreement are unacceptable to you or cause you to no longer compliant to this Agreement, you must deactivate your account, and should immediately stop using the Bookmyhelp Platform there itself
The Privacy Policy and the We Care are incorporated by reference into these Terms of Service and together form and are hereinafter referred to as the “Agreement”.
The Bookmyhelp Platform is a web- and app-based two-sided marketplace which enables connections between Clients and Helpers. “Clients” are individuals and/or businesses seeking to obtain short-term services (“Helps”) from Helpers. “Helpers” are businesses seeking to perform Helps for Clients. Clients and Helpers together are hereinafter referred to as “Users.”
Helpers are independent business owners. They are independent contractors engaged by clients and not employees, partners, representatives, agents, joint venturers, or franchisees of Bookmyhelp. Bookmyhelp does not perform Helps, nor does it employ individuals to perform tasks. Instead, Bookmyhelp operates as an online marketplace connecting people and businesses seeking services with service providers (Helpers) who wish to perform a variety of tasks.
Users acknowledge that Bookmyhelp does not supervise, scope, direct, control, or monitor a Helper’s work. Bookmyhelp expressly disclaims (to the extent permitted by law) any responsibility and liability for the work performed and the tasks in any manner, including but not limited to a warranty or condition of good and workmanlike services, quality, fitness for a particular purpose, or compliance with any law, statute, ordinance, regulation, or code.
Any reference on the Bookmyhelp Platform to a Helper being licensed or credentialed in some manner, or "Background Checked," “verified”, “Certified”, “Licensed”, “Insured”, “Skill Verified”(or similar language) designations indicates only that the Helper has completed a relevant account registration process or met certain criteria and does not represent anything else. Any such description is not an endorsement, certification or guarantee by Bookmyhelp of such Helper’s skills, qualifications, verification or notification whether they are licensed, insured, trustworthy, safe or suitable. Instead, any such description is intended to be useful information for Clients to evaluate when they make informed decisions about the identity and suitability of Helpers whom they select, interact, or contract with through the Bookmyhelp Platform.
The Bookmyhelp Platform enables connections between Users for the fulfillment of Helps. Bookmyhelp is not responsible for the performance or communications of Users, nor does it have control over the quality, timing, legality, failure to provide, or any other aspect whatsoever of Helps, Helpers, or Clients, nor of the integrity, responsibility, competence, qualifications, or any of the actions, omissions or errors whatsoever of any Users, or of any ratings or reviews provided by Users with respect to each other. Bookmyhelp makes no warranties or representations about the suitability, reliability, timeliness, or accuracy of the Helps requested or services provided by, or the communications of or between, Users identified through the Bookmyhelp Platform, whether in public or private, via on- or off-line interactions, or otherwise howsoever.
Helpers may be subject to a review process before they can register for and during their use of the Bookmyhelp Platform, which may include but is not limited to identity verification and criminal background checks, using third party services as appropriate (“Background Checks”). Although Bookmyhelp may perform Background Checks, Bookmyhelp cannot confirm that any User is who they claim to be, and Bookmyhelp cannot and does not assume any responsibility for the accuracy or reliability of Background Check information.
When interacting with other Users, you should exercise caution and common sense to protect your personal safety, data, and property, just as you would when interacting with other persons whom you don’t know. Bookmyhelp will not be liable for any false or misleading statements made by Users of the Bookmyhelp Platform.
Bookmyhelp may verify a Helper's ability to provide services in trade skills where certification or licensing is required by law. We may use third-party services for this verification. While Bookmyhelp may verify trade licenses and certificates, we do not assume responsibility for the accuracy or reliability of this information.
Bookmyhelp will not be liable for any false or misleading statements made by users of the Bookmyhelp platform.
Service Providers on the Bookmyhelp platform are required to maintain appropriate liability insurance, including but not limited to general liability, commercial liability, or professional liability insurance, as applicable to the trade they practice and in compliance with regional or national laws. This requirement ensures that Service Providers are adequately covered for any potential risks and liabilities associated with their services. Bookmyhelp will verify that each Service Provider has the necessary insurance coverage to uphold the highest standards of professionalism and safety. However, Bookmyhelp does not assume responsibility for the validity or sufficiency of the insurance coverage provided by the Service Providers. This verification is performed to foster a secure and reliable environment for both Helpers and Clients, and to maintain the integrity and trustworthiness of the Bookmyhelp platform.
Neither Bookmyhelp, nor its parents, affiliates, or licensors, including their respective directors, officers, shareholders, agents, investors, subsidiaries, attorneys, representatives, insurers, employees, successors, and assigns (collectively referred to as "Affiliates"), are responsible or liable for the conduct, acts, or omissions, whether online or offline, of any user of the Bookmyhelp platform. To the extent permitted by law, you hereby release Bookmyhelp and its Affiliates from any and all liability, claims, demands, or damages of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with the Bookmyhelp platform. Bookmyhelp is not responsible for any errors, omissions, or actions of any Helper before, during, or after the provision of their services. This includes, but is not limited to, any mistakes, negligence, misconduct, or failure to perform the agreed-upon tasks by the Helper. Bookmyhelp does not guarantee the quality, safety, or legality of the services provided by Helpers, nor does it endorse or validate their qualifications, certifications, or background. Clients are solely responsible for evaluating and selecting Helpers and should exercise caution and due diligence in all interactions. Bookmyhelp disclaims any liability for any damages, losses, or disputes arising from or related to the services provided by Helpers, including but not limited to personal injury, property damage, financial loss, or any other harm or inconvenience experienced by Clients or third parties.

Bookmyhelp as an Independent Platform:
Bookmyhelp is not a party to any Service Agreement, and the formation of such an agreement does not create an employment or service relationship between Bookmyhelp and the Helper, nor between the Client and the Helper. Users do not have the authority to enter written or oral contracts, whether implied or expressed, on behalf of Bookmyhelp.
Helper Engagement and Responsibility:
With prior approval from the Client, Helpers are not required to personally perform the Help and may engage assistants, helpers, subcontractors, or other personnel (collectively “Helper Assistants”). For safety reasons, these Helper Assistants must be registered through the Bookmyhelp platform. Non-compliance with this requirement is a violation of these Terms of Service and may result in removal from the platform. The Helper is fully responsible for the actions and omissions of their Helper Assistants, including lawful payment of compensation, benefits, expenses, and any applicable tax withholdings. Clients must confirm that any Helper Assistants are registered on the Bookmyhelp platform.
Client's Agent Authorization:
Clients have the discretion to decide whether to be present during the performance of a Help. If another person books the Help on behalf of the Client or is present instead of the Client, that person is considered the Client's agent (“Client’s Agent”), and the Helper may take directions from the Client’s Agent as if given by the Client. By acting as a Client’s Agent, you represent that you have the authority to bind the Client to all terms of the Service Agreement and these Terms of Service. The Client’s Agent can authorize any applicable waiver of the Client’s scoping, direction, or instruction of the Help. The Client is responsible and liable for all actions and directions given by the Client’s Agent.
Payment Obligations:
The Client must pay their Helper(s) in full for all services via the authorized third-party payment service provider as indicated on the Bookmyhelp platform, at the rates agreed upon in the Service Agreement. Users agree to comply with the terms of both the Service Agreement and these Terms of Service during the engagement, performance, and completion of a Help.
Bookmyhelp will not be a party to any contracts for Helps or services. The Client, and not Bookmyhelp, is responsible for payment for all Help services through the Bookmyhelp Platform. Such payment must be made via the authorized third-party payment provider.
The Help Service Charge, Trustworthiness and Assurance Fee, Taxes as applicable, cancellation charges, penalty fee or any other charges must be paid through the authorized third-party payment provider. Clients on the Bookmyhelp Platform will be required to provide their payment method details to Bookmyhelp. Helpers will be responsible for paying background check fees, repayment of erroneous payments, and registration fees, if applicable.
Helpers will be required to set up an account with the authorized third-party payment provider, which may require registration, consent to the terms of service, and completion of a vetting process and/or account validation or adhere to any other instruction as required by the authorized third-party payment provider. The Helper agrees that Bookmyhelp has no obligations, responsibility or liability to any Helper or other party for any error or omission made by the authorized third-party payment service provider.
To help prevent fraud and safeguard User information from the risk of unauthorized access, Bookmyhelp may validate an account before activation and prior to each booking.
When Client receives confirmation through the Bookmyhelp Platform or via email that a Help has been completed, Client automatically authorizes to process the payment. Clients may be billed a one-hour cancellation charge as damages at the Helper’s hourly rate if you book a Help, but cancel it before the scheduled time for performance
Bookmyhelp reserves the right (but not the obligation) upon request from Client or Helper, or upon notice of any potential fraud, unauthorized charges or other misuse of the Bookmyhelp Platform, to place on hold any Help Payment, out of pocket expenses, and/or tip or gratuity (if applicable), or refund or provide credits, or arrange for the authorized third-party payment provider to do so.
Users of the Bookmyhelp Platform may be liable for any taxes or similar charges required to be collected and/or paid on the Helps and/or fees provided under the Agreement.
In certain jurisdictions, applicable rules may require that we collect or report tax and/or revenue information about you. You agree that Bookmyhelp may issue on your behalf receipts or similar documentation to facilitate accurate tax reporting.
Bookmyhelp may periodically offer promotional opportunities to Users. These promotions are conducted at the sole discretion of Bookmyhelp and may be implemented, modified, or discontinued at any time without prior notice. The liability of Bookmyhelp, its Affiliates, and any corporate partners in relation to these promotional opportunities and contests is governed by the limitations outlined further in these Terms of Service.
Bookmyhelp promotional codes (“Promo Codes”) may be provided and can be used to offset Help Payments, the Bookmyhelp service charge, and the Trust & Support fee, either partially or in full. However, Promo Codes cannot be used to cover reimbursement of out-of-pocket expenses, tips, or gratuities related to a Help provided through the Bookmyhelp platform.
Promo Codes are offered by Bookmyhelp to reduce the amount a Client must pay for a Help Payment, service charge, and/or Trust & Support fee. The use of Promo Codes does not affect the amount the Helper ultimately receives for their services. Promo Codes are intended purely as promotional tools and do not create any relationship or engagement between Bookmyhelp and the Helper or Client, nor do they constitute wages, fees, or other amounts paid to the Helper. Users agree to use Promo Codes in accordance with the specific terms and conditions governing their use. A new user Promo Code may only be used once per User, regardless of the email address used during registration.
Bookmyhelp reserves the right to withhold or deduct credits, features, or benefits obtained through the use of a Promo Code if it determines that the use or redemption of the Promo Code was erroneous, fraudulent, illegal, or otherwise in violation of the applicable Promo Code terms and conditions or these Terms of Service.
The Bookmyhelp Platform may include profiles, email systems, blogs, message boards, reviews, ratings, task postings, chat areas, news groups, forums, communities, and other communication facilities (collectively referred to as "Public Areas") that facilitate interactions between Users. Users can use these Public Areas only to exchange messages and materials relevant and appropriate to the specific forum. For the safety and integrity of the Bookmyhelp Platform, Users should avoid sharing personal contact information with other Users.
Prohibited Uses
The Bookmyhelp Platform must not be used for:
Defaming, abusing, harassing, stalking, threatening, intimidating, misrepresenting, misleading, or otherwise infringing on the rights (including privacy, confidentiality, reputation, and publicity) of others, including Users and Bookmyhelp staff.
Publishing, posting, uploading, distributing, or disseminating any content that is profane, defamatory, infringing, obscene, or unlawful.
Uploading files that violate the intellectual property rights or privacy rights of any User, third party, or Bookmyhelp.
Uploading harmful files or scripts, such as viruses, worms, or malware, that could damage Bookmyhelp or Users' computers.
Advertising or offering goods or services for commercial purposes unrelated to Help services on the Bookmyhelp Platform.
Posting or completing a Help that requires any illegal, dangerous, or inappropriate activity as determined by Bookmyhelp.
Conducting or forwarding surveys, contests, pyramid schemes, or chain letters.
Impersonating another person or allowing anyone else to use your profile and access Bookmyhelp Users privileges.
Additional Restrictions
While using the Bookmyhelp Platform, Users must not:
By participating in Public Areas, you acknowledge that all submissions will be public, and you will be identified by your name or login information. Bookmyhelp is not responsible for the actions of any Users regarding information or materials posted in Public Areas.
By installing the App(s) provided through the Bookmyhelp Platform, you consent to the installation of the App(s) and any subsequent updates or upgrades that may be released. The App, including any updates or upgrades, may
(i) enable your device to automatically communicate with Bookmyhelp's servers to facilitate the functionality of the App and record usage metrics,
(ii) modify App-related preferences or data stored on your device, and
(iii) collect personal information in accordance with our Privacy Policy. You have the right to uninstall the App(s) at any time.
Bookmyhelp may suspend your access to the Bookmyhelp Platform while investigating a potential breach of this Agreement. If it is determined that you have violated any provision of this Agreement (a "User Breach"), Bookmyhelp may deactivate your account or restrict your use of the Platform. If your account is suspended, deactivated, or restricted, you are prohibited from creating or registering a new account under your name, a fictitious name, or the name of any third party, even if acting on behalf of that party.
The Agreement remains enforceable even if your access to the Platform is suspended, terminated, or limited. Bookmyhelp reserves the right to take appropriate legal action as necessary.
Bookmyhelp may, at its sole discretion, modify or discontinue all or any part of the Platform temporarily or permanently. To the extent permitted by law, Bookmyhelp is not liable for any modifications or discontinuations of the Platform. Additionally, Bookmyhelp reserves the right to restrict registration of any individual who may pose a threat to the safety or integrity of the Platform or for any other reasonable business reason. You may terminate this Agreement at any time by discontinuing your use of the Platform and deactivating your account.
You must register with Bookmyhelp and create an account to use the Bookmyhelp Platform. You are responsible for maintaining the confidentiality of any log-in, password, and account number provided by you or given to you by Bookmyhelp for accessing the Bookmyhelp Platform. You are solely and fully responsible for all activities that occur under your password or account, even if not authorized by you. Should you suspect that any unauthorized party may be using your password or account, or you suspect any other breach of security, you agree to notify Bookmyhelp immediately.
You acknowledge that telephone calls to or from Bookmyhelp, together with its agents and Affiliates, may be monitored and recorded for the purposes of quality control and training.
You verify that any contact information provided to Bookmyhelp, its agents and Affiliates, and Users, including, but not limited to, your name, business name, mailing address, email address, your residential or business telephone number, and/or your mobile telephone number, is true and accurate. You verify you are the current subscriber or owner of any telephone number you provide. You are strictly prohibited from providing a phone number that is not your own. If we discover that any information provided in connection with your registration is false or inaccurate, we may suspend or deactivate your account. Should any of your contact information change, you agree to immediately notify Bookmyhelp before the change goes into effect by visiting support.Bookmyhelp.com.
"User-Generated Content" refers to any information and materials you provide to Bookmyhelp, its agents, affiliates, corporate partners, or other users through your registration, use of the Bookmyhelp Platform, or participation in Bookmyhelp promotional campaigns. This includes, but is not limited to, information and materials posted or transmitted in Public Areas.
You are solely responsible for your User-Generated Content. Bookmyhelp acts only as a passive conduit for the distribution and publication of such content. Bookmyhelp is not involved in creating or developing User-Generated Content and disclaims any responsibility or liability for claims related to it. Bookmyhelp is under no obligation to monitor or review User-Generated Content but reserves the right to remove or restrict content that does not comply with this Agreement.
You represent and warrant that your User-Generated Content will not:
The Bookmyhelp Platform may feature User-Generated Content related to reviews and ratings of Helpers ("Feedback"). Feedback represents the opinions of individual users and has not been verified or endorsed by Bookmyhelp. Bookmyhelp is not responsible for the content of Feedback or any User-Generated Content. Users are encouraged to provide honest and constructive Feedback. Bookmyhelp may, at its discretion, investigate remarks for accuracy but is not obligated to do so. If you believe any Feedback violates this Agreement or the Bookmyhelp Ratings and Reviews Policy, you may request its removal by contacting the Support team at support@Bookmyhelp.com. Clients should conduct their own research to ensure Helpers have the appropriate qualifications for the Help.
Bookmyhelp respects personal and other rights and expects users to do the same. Bookmyhelp may disclose user identities to third parties who claim their rights have been infringed to facilitate resolution of such claims.
If you believe User-Generated Content is objectionable or infringes on rights, or if you discover content that promotes criminal activities, incites violence, or involves child pornography, you should notify Bookmyhelp immediately at support@Bookmyhelp.com
Bookmyhelp operates as an online marketplace that connects Clients with service providers (Helpers) who wish to perform a variety of Helps. Bookmyhelp does not perform Helps and does not employ people to perform Helps. Helpers operate as independent business owners and are customarily engaged in an independently established business of the same nature as that involved in the services performed for Clients through the Bookmyhelp Platform. Bookmyhelp does not control or direct the Helpers’ performance of their services or set their work locations, work hours, or terms of work. Helpers provide services under their own name or business name, and not under Bookmyhelp’s name. Helpers provide their own tools and supplies to perform their services; Bookmyhelp does not provide the tools or supplies. Helpers are free to maintain a clientele without any restrictions from Bookmyhelp and are free to offer and provide their services elsewhere, including through competing platforms. Helpers are free to accept or reject Clients and contracts. Helpers are not penalized for rejecting Clients or contracts, though if Helpers accept a Client or contract through the Bookmyhelp Platform, they are expected to fulfill their contractual obligations to their client. Helpers set their own rates for services performed in the Bookmyhelp general marketplace, without deduction by Bookmyhelp.
Helpers acknowledge and confirm that they are responsible for exercising their own business judgment in entering into Service Agreements and performing Helps and that, depending on how they exercise such business judgment, there is a chance for individual profit or loss.
The Bookmyhelp Platform may contain links (such as hyperlinks) to third-party websites. Such links do not constitute endorsement by Bookmyhelp or association with those websites, their content or their operators. Such links are provided as an information service, for reference and convenience only. Bookmyhelp does not control any such websites, and is not responsible for their availability, accuracy, content, advertising, products, or services. You acknowledge and agree that Bookmyhelp is not involved in the creation or development of third-party websites and disclaims any responsibility for third-party websites and cannot be liable for claims arising out of or relating to third-party websites.
The Bookmyhelp We Care applicable to the country where the Help is performed is part of this Agreement and incorporated by reference. Helpers determine which categories they are qualified to task in, and scope the Help directly with their Client. Bookmyhelp does not oversee, monitor or direct how a Helper performs a Help, does not monitor Helps or chat threads between Users, and does not otherwise assume responsibility for the actions of Users. Clients are advised to confirm with their Helper that s/he is qualified to perform the Help prior to the Help taking place. Bookmyhelp is not liable for the acts or omissions of Users, nor does Bookmyhelp provide insurance against any losses sustained by Users. That said, Bookmyhelp wants Users to be happy about their experience using the Bookmyhelp Platform and the We Care is in place to encourage continued use of the Bookmyhelp Platform.
All text, graphics, editorial content, data, formatting, graphs, designs, HTML, look and feel, photographs, music, sounds, images, software, videos, typefaces and other content, including Bookmyhelp designs, trademarks, and logos (collectively “Proprietary Material” ) that Users see or read through the Bookmyhelp Platform is owned by Bookmyhelp, excluding User Generated Content, which Users hereby grant Bookmyhelp a license to use as set forth above in Section 14. Proprietary Material is protected in all forms, media and technologies now known or hereinafter developed. Bookmyhelp owns all Proprietary Material, as well as the coordination, selection, arrangement and enhancement of such Proprietary Materials. The Proprietary Material is protected by domestic and international laws governing copyright, patents, and other proprietary rights. Users may not copy, download, use, redesign, reconfigure, or retransmit anything from the Bookmyhelp Platform without Bookmyhelp’s express prior written consent and, if applicable, the consent of the holder of the rights to the User Generated Content. Any use of such Proprietary Material other than as permitted herein is expressly prohibited.
The service marks and trademarks of Bookmyhelp, including without limitation Bookmyhelp, Bookmyhelp for Good, and associated logos, are service marks owned by Bookmyhelp. Any other trademarks, service marks, logos and/or trade names appearing via the Bookmyhelp Platform are the property of their respective owners. Bookmyhelp’s proprietary marks and logos are not available for use by Helpers. You may not copy or use any of these marks, logos or trade names without the express prior written consent of the owner.
Bookmyhelp respects the intellectual property of others and expects Users to do the same. If you believe, in good faith, that any materials provided on or in connection with the Bookmyhelp Platform infringe upon your copyright or other intellectual property right, please email at support@Bookmyhelp.com.
To expedite resolution and reduce the cost of any dispute, controversy or claim related to, arising from or regarding your use of the Bookmyhelp Platform, your relationship with Bookmyhelp, Helps, or this Agreement (including previous versions), (“Dispute”), you and Bookmyhelp agree to first attempt to negotiate any Dispute informally for at least 30 days before initiating any out of court settlement. Except as expressly provided otherwise, this Agreement and your use of the Bookmyhelp Platform will be governed by, and will be construed under, the laws of the Province of Ontario, without regard to choice of law principles. This choice of law provision is only intended to specify the use of Ontario law to interpret this Agreement and is not intended to create any substantive right to non-residents of Ontario to assert claims under Ontario law whether by statute, common law, or otherwise.
By using the Bookmyhelp Platform, you acknowledge that you have read and understood these Terms of Service, the Privacy Policy. Your use of the Bookmyhelp Platform signifies your agreement to be bound by the terms and conditions set forth in this Agreement.
